A 37-year-old Spring man is in the Montgomery County Jail after Precinct 3 detectives arrested him Monday, Aug. 10, on a felony family violence charge stemming from a Friday, Aug. 7, assault at a Spring residence.

Alfonso J. Aguilar faces a charge of assault of a family member by impeding breath or circulation, a third-degree felony that carries two to 10 years in prison and up to a $10,000 fine under Texas Penal Code.

Deputies with Constable Ryan Gable's office responded to the reported assault on Friday, Aug. 7, according to a Precinct 3 press release and Woodlands Online. Investigators determined Aguilar allegedly applied pressure to the victim's neck, impeding the victim's breathing, then fled the scene.

The victim was examined at a hospital, where medical personnel documented injuries consistent with the reported assault.

Precinct 3 detectives reviewed the case, established probable cause and obtained an arrest warrant for Aguilar. Detectives located him at a hotel in The Woodlands on Aug. 10 and took him into custody without incident.

He did not resist.

Gable's office called strangulation a serious and potentially deadly offense in the release. Under Texas law, the charge applies even when no serious bodily injury occurs; prosecutors need only show the defendant intentionally, knowingly or recklessly impeded normal breathing or circulation.

No bond information or court date has been released.

Aguilar is presumed innocent unless proven guilty in a court of law.
